Terms of Service
These Terms of Service govern access to and use of StoreVoice AI, a WooCommerce and WordPress voice AI customer support service operated by Kanzu Code Inc. They are written for business customers using StoreVoice AI to automate customer calls, product questions, shipping policy questions, returns, refunds, store policy questions, and related ecommerce support workflows.
Please read these Terms carefully. By creating an account, installing or configuring the StoreVoice AI plugin, connecting a store, booking or using a demo, subscribing to a paid plan, or otherwise accessing the Service, you agree to be bound by these Terms on behalf of yourself and the business, organization, or other legal entity you represent. If you do not agree, do not access or use the Service.
1. Definitions
"StoreVoice AI," "we," "us," and "our" mean Kanzu Code Inc. and the StoreVoice AI products and services it operates.
"Service" means the StoreVoice AI website, software, WordPress or WooCommerce plugin, hosted services, voice AI agents, dashboards, documentation, APIs, integrations, call flows, analytics, support services, beta features, and any related functionality we provide.
"Customer," "Merchant," "you," and "your" mean the person or legal entity that accesses or uses the Service, including any store owner, ecommerce business, agency, administrator, employee, contractor, or authorized user acting on its behalf.
"End User" means any shopper, caller, customer, prospect, visitor, or other individual who interacts with your store, your website, your phone number, the AI voice agent, or any customer support workflow powered by the Service.
"Customer Data" means information that you, your store, your systems, your users, or your End Users submit to, connect with, or make available through the Service. Customer Data may include WooCommerce order data, product catalog data, customer account information, call content, transcripts, support questions, return requests, refund questions, store policies, FAQs, knowledge base content, and configuration settings.
"Service Data" means usage, diagnostic, operational, performance, security, billing, analytics, and technical data generated by or relating to operation of the Service, excluding Customer Data except as aggregated or de-identified in accordance with these Terms and our Privacy Policy.
2. Eligibility and Authority
The Service is intended for business use and is not directed to consumers for personal, family, or household use. You may use the Service only if you are legally able to enter into a binding agreement and are not barred from using the Service under applicable law.
If you use the Service on behalf of a company, store, agency, client, or other organization, you represent and warrant that you have authority to bind that entity to these Terms. If you do not have that authority, you may not access or use the Service on behalf of that entity.
3. The Service
StoreVoice AI provides voice AI customer support functionality for WooCommerce and WordPress stores. Depending on your plan, configuration, and enabled features, the Service may help answer customer calls, respond to product questions, explain store and shipping policies, guide return or refund workflows, answer common questions, collect support details, route requests, provide transcripts or analytics, and support related ecommerce customer service tasks.
The Service is a support automation tool. It does not replace your responsibility to operate your business, maintain your store, honor customer rights, comply with laws, review important support decisions, and provide human review when appropriate.
We may add, modify, suspend, discontinue, or limit features from time to time. We will use commercially reasonable efforts to avoid material disruption to paid subscriptions, but we do not guarantee that every feature will always remain available, uninterrupted, compatible, or unchanged.
4. Accounts and Administration
You are responsible for maintaining accurate account, billing, store, and administrative information. You are also responsible for all activity under your account, including activity by employees, contractors, agencies, administrators, and other authorized users.
- You must keep credentials, API keys, plugin access, dashboard access, and integration tokens secure.
- You must promptly notify us through the contact page if you believe your account, store connection, phone workflow, or credentials have been compromised.
- You must ensure that each person with administrative access has appropriate authority and uses the Service only for legitimate business purposes.
- You are responsible for configuring user roles, permissions, store policies, knowledge base content, call handling preferences, escalation settings, and any human review procedures.
5. Merchant Responsibilities
You are solely responsible for your store, your products, your customer relationships, your policies, your legal notices, your instructions to StoreVoice AI, and the business decisions made using the Service.
Without limiting the foregoing, you are responsible for:
- Providing accurate, current, and complete product, order, shipping, return, refund, warranty, pricing, promotion, tax, and policy information.
- Reviewing AI voice agent behavior, call scripts, escalation rules, and customer-facing responses before using them in production.
- Obtaining any consents, notices, permissions, and authorizations required to record, transcribe, analyze, or automate customer calls and support interactions.
- Ensuring that your use of the Service complies with ecommerce, consumer protection, advertising, privacy, data protection, telecommunications, accessibility, and call recording laws that apply to your business.
- Responding to customers when the Service escalates a matter, cannot answer confidently, detects a sensitive request, or requires human assistance.
- Backing up and maintaining your own business records, including orders, customer communications, policies, and support history.
6. Acceptable Use
You may not use, permit use of, or assist others in using the Service in any unlawful, harmful, abusive, deceptive, or high-risk manner. Prohibited conduct includes:
- Violating applicable laws, regulations, sanctions, export controls, consumer protection requirements, privacy laws, telecommunications rules, or third-party rights.
- Using the Service to place unlawful robocalls, spam calls, unsolicited marketing calls, deceptive calls, abusive calls, or communications without required consent.
- Submitting, generating, or transmitting malware, malicious code, unlawful content, infringing content, hate or harassment, threats, sexual exploitation material, or content that facilitates fraud or harm.
- Attempting to reverse engineer, decompile, scrape, crawl, overload, disrupt, probe, scan, or gain unauthorized access to the Service or related systems.
- Bypassing usage limits, security controls, authentication, rate limits, billing meters, plan restrictions, or technical safeguards.
- Using the Service for emergency services, medical diagnosis, legal advice, financial advice, regulated credit decisions, employment decisions, housing decisions, insurance decisions, or other high-impact decisions unless expressly authorized in a separate written agreement.
- Misrepresenting that AI-generated responses are human-generated where disclosure is required by law or by your own customer promises.
We may investigate suspected violations and may suspend or terminate access if we reasonably believe the Service is being used in a way that creates legal, security, operational, reputational, or safety risk.
7. AI Voice Agent Output
The Service uses automated systems, including artificial intelligence and speech technologies, to interpret caller requests and generate responses. AI output may be incomplete, inaccurate, delayed, inconsistent, or inappropriate for a particular circumstance. You are responsible for testing, monitoring, and reviewing the Service and for determining whether output is suitable for your use case.
You should configure the Service to escalate sensitive, uncertain, disputed, unusual, high-value, or legally significant matters to a human representative. StoreVoice AI does not guarantee that every customer request will be correctly understood, answered, or resolved.
You acknowledge that AI-generated information is not legal, tax, accounting, medical, financial, compliance, or professional advice. You must not rely on the Service as the sole basis for decisions that require professional judgment, human review, or legally mandated processes.
8. Customer Communications and Call Compliance
You are responsible for all communications sent, received, recorded, transcribed, analyzed, or generated through the Service in connection with your store. This includes responsibility for the content of greetings, disclosures, call flows, scripts, prompts, knowledge base responses, SMS or email follow-ups if enabled, and customer-facing notices.
You are responsible for complying with all laws and industry rules that apply to your communications, including call recording consent, AI disclosure requirements, telephone consumer protection rules, telemarketing rules, do-not-call rules, electronic communications laws, accessibility requirements, and customer service obligations.
If applicable law requires notice or consent before recording, monitoring, transcribing, analyzing, or using AI in a call, you must ensure that appropriate notice is provided and valid consent is obtained before using the Service for those calls.
9. WooCommerce, WordPress, and Third-Party Integrations
The Service may connect with WooCommerce, WordPress, payment processors, shipping providers, telephony providers, AI infrastructure providers, analytics providers, hosting providers, support tools, knowledge bases, and other third-party products or services. Third-party services are not controlled by StoreVoice AI and may be subject to separate terms, privacy policies, fees, limits, security practices, availability commitments, and data handling rules.
You authorize StoreVoice AI to access, process, transmit, and use data from connected integrations as necessary to provide the Service. You represent that you have all rights, permissions, and authorizations required to connect those integrations and make their data available to the Service.
We are not responsible for third-party service outages, changes, errors, security incidents, pricing changes, API limits, data loss, or failures. If a third-party integration becomes unavailable or changes its functionality, the Service may be affected.
10. Customer Data and Service Data
As between you and StoreVoice AI, you retain ownership of Customer Data. You grant StoreVoice AI a non-exclusive, worldwide, royalty-free license to host, copy, transmit, display, process, analyze, and use Customer Data as necessary to provide, secure, support, maintain, improve, and troubleshoot the Service; comply with law; enforce these Terms; and protect the rights, safety, and security of StoreVoice AI, our customers, End Users, and others.
You are responsible for the accuracy, quality, legality, and integrity of Customer Data. You must not submit Customer Data unless you have the rights and permissions necessary for StoreVoice AI to process it as described in these Terms and our Privacy Policy.
We may generate Service Data from use of the Service. We may use Service Data to operate, monitor, secure, improve, and support the Service; develop new features; produce aggregated or de-identified analytics; detect abuse; and comply with legal obligations. We will not identify you or your End Users in public aggregated reports without permission.
11. Security
We use commercially reasonable administrative, technical, and organizational measures designed to protect the Service. However, no system, network, storage environment, software, AI model, or transmission method can be guaranteed to be completely secure.
You are responsible for securing your own systems, devices, accounts, WooCommerce store, WordPress installation, plugins, themes, credentials, network access, and administrative users. You must promptly apply security updates, remove unused access, use strong authentication practices, and follow reasonable security procedures for your store and connected systems.
12. Plans, Fees, Taxes, and Billing
Paid plans, usage allowances, included minutes, support levels, overage terms, setup services, and feature limits are described on the website, in the applicable order form, or in a separate written agreement. Fees are due according to the billing terms presented at purchase or agreed in writing.
- You authorize us and our payment processors to charge applicable fees, taxes, recurring subscription amounts, usage-based charges, overages, and other amounts due.
- Unless stated otherwise in writing, fees are non-refundable except where required by law or expressly provided in the applicable plan terms.
- You are responsible for all taxes, duties, levies, and governmental assessments, excluding taxes based on our net income.
- If payment is late, failed, disputed, reversed, or incomplete, we may suspend or limit access to the Service after reasonable notice where practical.
- Plan limits may include call minutes, phone numbers, stores, knowledge base size, support level, integrations, users, or other usage metrics.
13. Trials, Demos, and Beta Features
We may offer demos, trials, previews, pilots, experimental features, or beta functionality. These offerings may be limited, modified, or discontinued at any time and may not be covered by the same support, availability, security, or performance commitments as generally available paid features.
Beta features are provided for evaluation and may contain errors, produce unexpected output, change materially, or never become generally available. You should not use beta features for mission-critical workflows or production customer support unless you accept those risks.
14. Availability and Support
We use commercially reasonable efforts to provide the Service reliably, but the Service may be interrupted, delayed, degraded, or unavailable due to maintenance, updates, outages, third-party failures, abuse prevention, security incidents, capacity constraints, telecommunications issues, force majeure events, or circumstances beyond our reasonable control.
Support, response times, onboarding assistance, setup calls, priority support, and dedicated support are provided according to your plan or separate written agreement. We may use diagnostic data, logs, transcripts, configuration details, and account information to investigate and resolve support issues.
15. Intellectual Property
StoreVoice AI and its licensors own all rights, title, and interest in and to the Service, including software, technology, interfaces, designs, models, workflows, documentation, trademarks, logos, and other materials, except for Customer Data and third-party materials. No rights are granted except as expressly stated in these Terms.
Subject to these Terms and your payment of applicable fees, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable right to access and use the Service for your internal business purposes during the applicable subscription term.
If you provide feedback, suggestions, ideas, or recommendations, you grant us a perpetual, irrevocable, worldwide, royalty-free license to use them without restriction or compensation, provided we do not disclose your confidential information in doing so.
16. Confidentiality
Each party may receive non-public business, technical, financial, product, security, or operational information from the other party that a reasonable person would understand to be confidential. The receiving party will use confidential information only to perform under these Terms and will protect it using reasonable care.
Confidentiality obligations do not apply to information that is publicly available without breach, already known without restriction, independently developed without use of confidential information, lawfully received from a third party, or required to be disclosed by law. If legally required to disclose confidential information, the receiving party will provide notice where legally permitted.
17. Privacy
Our Privacy Policy explains how we collect, use, disclose, retain, and protect personal information. By using the Service, you acknowledge our Privacy Policy. You are responsible for providing all privacy notices and obtaining all consents required for your use of the Service, including notices to End Users about AI voice support, call recording, transcription, automated processing, and data sharing where required.
If a separate data processing agreement is required by applicable law or by your written agreement with us, the data processing agreement will control for the processing of personal information within its scope.
18. Disclaimers
To the maximum extent permitted by law, the Service is provided "as is" and "as available." StoreVoice AI disclaims all warranties, whether express, implied, statutory, or otherwise, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, quiet enjoyment, availability, security, and error-free operation.
We do not warrant that the Service will meet your requirements, operate without interruption, produce accurate or complete output, prevent all fraud or abuse, satisfy any legal obligation, integrate with every store configuration, or remain compatible with every plugin, theme, browser, device, carrier, hosting provider, or third-party service.
19. Limitation of Liability
To the maximum extent permitted by law, StoreVoice AI and its officers, directors, employees, contractors, affiliates, suppliers, and licensors will not be liable for indirect, incidental, special, consequential, exemplary, enhanced, or punitive damages, or for lost profits, lost revenue, lost business, lost goodwill, lost data, service interruption, customer claims, or cost of substitute services, even if advised of the possibility of such damages.
To the maximum extent permitted by law, our aggregate liability arising out of or relating to the Service or these Terms will not exceed the greater of one hundred U.S. dollars (US$100) or the amounts you paid to StoreVoice AI for the Service giving rise to the claim during the three months before the event giving rise to liability.
Some jurisdictions do not allow certain exclusions or limitations of liability. In those jurisdictions, liability will be limited to the maximum extent permitted by law.
20. Indemnification
You will defend, indemnify, and hold harmless StoreVoice AI and its officers, directors, employees, contractors, affiliates, suppliers, and licensors from and against any claims, damages, losses, liabilities, costs, and expenses, including reasonable attorneys' fees, arising out of or related to:
- Your use of the Service or Customer Data.
- Your store, products, services, policies, customer communications, call content, support decisions, or business operations.
- Your violation of these Terms, applicable law, or third-party rights.
- Your failure to obtain required notices, consents, permissions, or authorizations.
- Disputes between you and End Users, customers, employees, contractors, agencies, partners, or third-party providers.
21. Suspension and Termination
You may stop using the Service at any time. Subscription cancellation, non-renewal, data export, deletion, refund eligibility, and post-termination access are governed by your plan, billing settings, and any separate written agreement.
We may suspend, limit, or terminate access to the Service if you breach these Terms, fail to pay amounts due, create legal or security risk, use the Service in a prohibited manner, provide inaccurate account information, infringe third-party rights, or if we are required to do so by law or by a third-party provider.
Upon termination, your right to access and use the Service will end. Sections that by their nature should survive termination will survive, including provisions relating to fees owed, data rights, confidentiality, intellectual property, disclaimers, limitation of liability, indemnification, dispute resolution, and general terms.
22. Governing Law and Disputes
These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles. Subject to any mandatory law that provides otherwise, the state and federal courts located in Delaware will have exclusive jurisdiction over disputes arising out of or relating to these Terms or the Service, and each party consents to personal jurisdiction and venue in those courts.
Before filing a claim, each party agrees to attempt in good faith to resolve the dispute informally by providing written notice describing the issue and allowing a reasonable opportunity to respond. Nothing in this section prevents either party from seeking injunctive or equitable relief for unauthorized access, misuse of confidential information, infringement, or security threats.
23. Changes to These Terms
We may update these Terms from time to time to reflect changes in the Service, business practices, legal requirements, security needs, or operational requirements. If we make material changes, we will provide notice by posting the updated Terms on the website or through another reasonable method.
Updated Terms become effective on the date identified above unless a later date is stated. Your continued use of the Service after updated Terms become effective constitutes acceptance of the updated Terms. If you do not agree to updated Terms, you must stop using the Service.
